People in five states may be eligible for a $29 Chick-fil-A gift card or cash payment as part of a class action settlement over delivery charges.
The popular fast food chain agreed to a $4.4 million settlement in a lawsuit claiming it misrepresented delivery fees and menu prices, Top Class Actions reported. Plaintiffs in the lawsuit allege that Chick-fil-A promised free or low-cost delivery on its app or website, but then marked up food prices on delivery orders by up to 30%.
Chick-fil-A has denied any wrongdoing, Top Class Actions and the settlement website say. A spokesperson for the company did not respond to a request for comment by the time of publishing.
Residents of California, Florida, Georgia, New Jersey or New York who made a delivery order through the Chick-fil-A One app or the chain’s website between Nov. 1, 2019, and April 30, 2021, are eligible for the settlement, according to the settlement website.
Eligible customers should have received an email from noreply@deliveryordersettlement.com with a claim ID number. People who did not receive an ID number but believe they should have can email info@deliveryordersettlement.com or call 1-877-764-4957.
People who are eligible to file a claim are expected to receive a cash award or Chick-fil-A gift card worth up to $29.25, the website says. The deadline to file a claim is Feb. 15, 2024.
According to Top Class Actions, $1.45 million of the settlement fund will go toward cash payments and $2.95 million will be used for gift cards.
A hearing to decide whether to approve the settlement is scheduled for Feb. 29. If the settlement is approved, people who filed a valid claim will get an email with information about how to receive a digital cash payment or gift card, the settlement website says.
