Prop. 140 will stay on the ballot, Arizona Supreme Court rules

If it passes, Arizona Proposition 140 would require a single primary election for all candidates and a possible ranked choice voting general election initiative.
The November elections will be about the future of elections in Maricopa County.

PHOENIX — Arizona voters will get the opportunity to decide whether or not they want open primary elections, the Arizona Supreme Court ruled Friday.

Arizona Proposition 140, also known as the Single Primary for All Candidates and Possible RCV General Election Initiative, would create a system where candidates — regardless of which party they're running with — would all appear on the same ticket.

In a four-page filing, the court unanimously dismissed a challenge to the proposition and ruled that votes would be counted.

Maricopa County Superior Court Judge Frank Moskowitz previously ruled that an attempt to get the proposition off the ballot came too late in the election process. The higher court reinforced his decision.

Chief Justice Ann A. Scott Timmer said that an opinion explaining the court's reasons would follow at a later time.
