PHOENIX — Proposition 138 is one of numerous propositions Arizona voters will vote for or against on Nov. 5.
What is Proposition 138?
Proposition 138 is the "Wages for Tipped Workers Amendment." It is a legislatively referred constitutional amendment, according to Ballotpedia.
The amendment, if passed, would allow employers to pay tipped workers 25% less per hour than the minimum wage if the employee received more than minimum wage plus $2 per hour worked in tips. That would be $10.77 per hour.
Current law states that tipped employees make $11.35 per hour.
That means that if an employee working an 8-hour shift made less than $106, they would be paid the minimum wage for tipped workers, which is $11.35. If they made more than $106 in tips, then if passed, the amendment would allow employers to pay tipped workers $10.77 per hour worked.
If the amendment is not passed, tipped workers will be paid the amount already in law, or $11.35 per hour.
