Suspect allegedly crawled into bathroom stall, attempted to assault 16-year-old at Valley grocery store

The suspect was taken into custody after the store's video surveillance helped police to identify him.

PHOENIX — Phoenix police have arrested a 24-year-old man who's accused of sliding into an occupied bathroom stall and exposing himself to a 16-year-old, court records show.

Daiveon Ellsberry was taken into custody on Feb. 5 after video surveillance identified him as the suspect who allegedly tried assaulting a teenager the night before. 

At about 11 p.m. on Feb. 4, a 16-year-old working inside a grocery store located near 40th Street and Chandler Boulevard went to the bathroom and reported hearing a belligerent man come in after them.

Records show the man then allegedly slid underneath the stall's divider with his pants down, exposing his genitals. The suspect grabbed the teen and the victim started screaming for help.

The victim managed to run out of the stall and reported the incident to their coworkers.

In an interview with police, Ellsberry allegedly admitted to following the 16-year-old into the bathroom, sliding into their stall, and "attempting to make sexual advances," court records show.

The suspect has been booked into the Maricopa County jail.
