Maricopa County Attorney's Office to review fatal Tempe police shooting involving 14-year-old

In the next step of the investigation, the county attorney's office will decide if charges will be filed against the officer who shot 14-year-old Antonio Arce while chasing him.

TEMPE, Ariz. — The Tempe Police Department is forwarding a case involving a police officer who shot and killed a teen suspect with an airsoft gun to the Maricopa County Attorney's Office for review.

Police say the county attorney's office will review the facts of the incident in which Tempe police officer Joseph Jaen fatally shot 14-year-old Antonio Arce on Jan. 15. 

The Maricopa County Attorney's Office will ultimately determine if any charges should be filed against the officer. 

It is normal protocol for the county attorney's office to investigate police shootings.

On Jan. 15, Tempe police say they were responding to a call of a suspicious car in an alley when Jaen saw Arce inside the pickup truck. The officer-worn body camera footage shows Arce running away, and Jaen chasing after him.

Jaen shot Arce twice from a distance, striking him once in the shoulder. The boy continued to run but collapsed on a street just outside the alleyway. 

A pellet gun with an orange point was found under Arce's right arm.
