JJ's grandmother, Kay Woodcock, took to social media saying the family is "grateful" following Boyce's order.
JJ and his family lived in Chandler before his mother moved the family to Rexburg, Idaho in the months leading up to his murder.
In May 2023, JJ's mother, Lori Vallow Daybell, was convicted of killing both JJ and his 16-year-old sister Tylee Ryan. She was also convicted of conspiracy to commit murder in the death of Tammy Daybell, who was married to Chad Daybell – Lori Vallow Daybell later married him.
The children disappeared in September 2019 and were never reported missing by Lori Vallow Daybell.
Both children were later found buried in the yard of Chad Daybell's Rexburg, Idaho home.
Lori Vallow Daybell was sentenced to life in prison without parole for her part in the murders.
Tylee's body has yet to be released.
Chad Daybell is awaiting trial for his alleged part in the killings.
Lori Vallow Daybell is also facing charges in Arizona. The county attorney’s office is in the process of extraditing her back to the state so she can face conspiracy charges out of Gilbert and Chandler. Those charges are connected to the death of Lori Vallow Daybell's husband Charles Vallow.
Prosecutors hope to have her in Arizona custody by the end of this year.
