Deaf man with cerebral palsy was shocked and punched by Phoenix police on camera. He has filed a $3.5M claim against the city.

Tyron McAlpin is deaf and has cerebral palsy. He was arrested by Phoenix police but charges against him were later dropped.

PHOENIX — Attorneys for a deaf Black man with cerebral palsy shocked and arrested by Phoenix police have notified the city of a claim against the city and police officer for the arrest in August.

On August 19, Phoenix Police Officers Benjamin Harris and Kyle Sue responded to a call at a Circle K parking lot regarding a fight a white man had started, according to police reports released by Tyron McAlpin's attorney. 

Based on the word of the man in the initial call, the officers approached McAlpin at a nearby Dollar Tree parking lot. Officers say they were attempting to arrest McAlpin when video shows them punching him and using a stun gun on him.

McAlpin was facing felony charges of resisting arrest and assaulting a police officer but those charges were later dismissed by the Maricopa County Attorney's Office. 

In the claim served to the City of Phoenix on Wednesday, attorneys notified the city that McAlpin would settle his claim against the city and its employees for $3.5 million.
