Deadly 'distracted driving' case ends in split verdict

Pima County Attorney Laura Conover said in a statement Friday that prosecutors will pursue a new trial in the case.

TUCSON, Arizona — Jana Giron has been found guilty of tampering with physical evidence after two weeks of trial in Pima County.

Giron was accused of killing Paul Garcia and Caitlin Festerling in 2019. The crash occurred near Shannon and Lambert Road.

Giron’s phone, which was seized by detectives, revealed that text messages to another parent from her child's soccer team had disappeared. She claimed the texts were sent before leaving home and was unsure why they were no longer on her phone.

On Nov. 13, 2019, Festerling and Garcia were traveling near Shannon Road and Sahuaro Divide when their vehicle was allegedly rear-ended by Giron.

The crash forced their car into oncoming traffic, where it was struck head-on by a truck. Both Festerling and Garcia were killed.

The jury reached no verdict on the other charges including manslaughter and negligent homicide.

Pima County Attorney Laura Conover said in a statement Friday that prosecutors will pursue a new trial in the case.
