TEMPE, Ariz. — A man who was shot and killed early Monday morning in Tempe has been identified by police.
Joseph Aguilar, 49, was pronounced dead after being shot near Scottsdale and McKellips roads just after midnight Monday, according to Tempe police. The shooting shut down the intersection during the morning commute.
Austin James-Raul Daleo, 22, was arrested and booked on charges of second-degree murder and reckless discharge of a firearm within city limits.
Police said Daleo and a companion were walking from a nearby sports bar when Aguilar approached them on his bicycle. Aguilar got off his bike and verbally attacked the companion, who told him to leave them alone. The companion told officers Aguilar wasn’t armed and she wasn’t afraid of him. When the companion looked down, Aguilar started approaching Daleo, and then she heard multiple gunshots, court records show.
The companion told officers she asked Daleo if those were blanks, to which he replied that they were not.
Another witness told officers the two men were arguing with each other before Daleo allegedly pulled out a gun and shot Aguilar several times.
