Phoenix business owner in legal battle with Red Bull over logo

Lentzke, a personal training coach with "Toro Performance," is frustrated with mega companies coming after the average business owner.

PHOENIX — A small Valley business in north Phoenix, "Toro Performance," is dealing with a big trademark battle against the popular energy drink Red Bull.

This has been an ongoing issue before with other businesses and brands and knows it can impact businesses working to develop a brand. 

We spoke to the owner Jason Lentzke about how to avoid losing his logo.

"We just don't understand why they would sue us when our flying bull looks so different than their charging bull," he said.

Lentzke, a personal training coach with "Toro Performance," is frustrated with mega-companies coming after the average business owner.

"They've done this to dozens of small businesses that haven't had the financial backing to take a company like Red Bull has," he added.

The trademark was approved by the United States Patent and Trademark Office back in February but over the summer Red Bull raised the red flag on alleged trademark infringement.

"Their claim is that they're just protecting their rights and that a consumer could be confused between the two brands and that Toro Performance could damage their brand," Lentzke added.

He says he's prepared to fight this claim in court and admits, a worst-case scenario would be to go back to the drawing board for branding.

"I've built this company from the ground up and gained some notoriety with our logo within the endurance community and I would hate to throw that all away," he told 12 News.

We reached out to Red Bull for comment regarding their concerns with the bull branding but have not yet heard back.
