VERIFY: After primary election day issues, promised report not coming

County Recorder Adrian Fontes said he would release a report by Thursday, but changed his mind after speaking to an attorney.

PHOENIX - More than 60 poll locations were not ready to be open during August's primary in Maricopa County.

"We weren’t available at 62 locations," Maricopa County Recorder Adrian Fontes said.

Fontes said the complications were caused by a company meant to help out with election machines "not doing their job."

That company denies any wrongdoing.

On Tuesday, Fontes held a Facebook Live video where he showed a draft of a report which he said would detail what went wrong on the day of the primary. Fontes said in the video the draft would be released on Wednesday or Thursday.

By the end of Thursday, Fontes said his mind changed after speaking to an attorney. The recorder said, according to the system in place, he can speak for the county when it comes to pre-election issues, but when it comes to election day problems, he is just an agent of the county. This would make it improper for him to make a comment on behalf of the entire county.

"I know our version of events is accurate, it’s supported by documents. And if there is ever more of an investigation, we will be in good shape," Fontes said.

However, those comments are unverified because the documents have not been released.

Fontes did not comment as to whether there were any ongoing lawsuits, but indicated that it was a possibility.

"I think there are some invoices I told my staff not to pay." Fontes said. “This company just did not perform."

Fontes said he was proud with the response of his team after things went wrong in the morning. He said having a "flex" system of 40 additional polling locations provided more options.

Wednesday, the county said there would be an audit of the election. The report mentioned by Fontes on Tuesday could be rolled into it.
